Terms & Conditions of Service

These terms govern your use of FlipItLeads.com and everything you buy from us. Please read them before ordering. By using the site, requesting the free trial or placing an order, you accept them.

1. Who we are

FlipItLeads.com is operated by American Cloud, Inc., 10120 S Eastern Ave STE 200, Henderson NV 89052. We have served real-estate investors since 2017 and are A+ rated with the Better Business Bureau.

2. What you are buying

We sell contact records for property owners ("Leads") to real-estate professionals. Each Lead includes the property address, the owner's name and mailing address, a mobile telephone number, and the property information shown on your delivery page.

Leads are sold in packages of different sizes. Every Lead on every order carries the replacement guarantee in section 4. Exclusive Area may be added to an order.

Current prices and package sizes are shown on the website and at checkout. Prices are in US dollars and may change; the price shown at checkout is the price you pay.

Leads are drawn from within a 45-mile radius of the ZIP code you choose. We cannot guarantee they will be spread evenly across that radius, or that any particular city or neighbourhood within it will be represented.

3. What a Lead is — and is not

Every Lead we deliver is a residential property not listed on the MLS when we supply it, with a mobile telephone number for the owner that we have checked against the federal Do Not Call Registry.

A Lead is not a deal, an appointment, an introduction, or a warm referral. It is not a representation that the owner intends to sell, has agreed to speak with you, or will list their property. It is not exclusive to you unless you purchase Exclusive Area.

Information changes. People move, change their numbers and take property off the market. We supply information we believe accurate at the time of delivery; we cannot warrant it stays accurate afterwards.

4. The replacement guarantee

We guarantee that the mobile telephone number we supply with each Lead reaches that property's owner. Where it does not, we replace the Lead free of charge. There is nothing to return and no minimum claim — one Lead is enough.

A Lead qualifies for replacement if the number we supplied:

• is disconnected or unobtainable; or
• reaches somebody who is not the owner and has no connection to the property.

Claim by email within 30 days of delivery, telling us which Leads.

How we check a claim

We attempt the number ourselves over three days before deciding. If we reach the owner, we tell you when we got through and pass on anything they said. If we cannot, we replace the Lead with another in the same area, matched as closely as we can to the order you placed.

We will tell you the outcome of our review and what it was based on.

What this guarantee covers, and what it does not. It covers the number connecting you to the owner — nothing beyond that. It is not a promise that the owner wants to sell, that they will speak to you, or that you will close a deal. How many Leads it takes to close one depends on your own approach, your negotiation and how quickly you work them; some investors close one in five, others close none. We guarantee we hand you a working line to the owner. The conversation is yours.

5. Exclusive Area

Exclusive Area is an optional addition to an order. What it covers is described on the checkout page at the time you buy, and those terms apply to your order.

We may change what Exclusive Area includes for future orders. Any change applies only to orders placed after it takes effect — it never alters what was promised on an order already placed.

6. Free trial

We offer 25 Leads at no charge, with no credit card required.

• The Leads are emailed to you as a spreadsheet and are yours to keep permanently.
• Online access to the property pages runs for 7 days from delivery, then closes. Your spreadsheet is unaffected.
• Nothing is charged and no card is stored. The trial does not turn into a paid subscription and there is nothing to cancel.
• One trial per person. We decline a second trial to the same email address, telephone number or internet connection.

7. Payment, delivery and refunds

Payment is handled by Authorize.Net. We never receive or store your full card number. Your statement shows the charge as "Online Offers".

Delivery. Leads are prepared after payment and sent by email, with online access at a private link.

Cancellation. An order may be cancelled only before the Leads have been delivered. If you cancel in time, you are refunded in full.

Once your Leads have been delivered, the order cannot be cancelled and is not refundable. Leads are information, and information cannot be returned once it has been seen. Your remedy after delivery is the replacement guarantee in section 4. It is settled by replacing the Lead, not by refunding it; we do not refund a delivered order.

Chargebacks. If you dispute a charge with your card issuer instead of contacting us, we may decline to serve you again.

8. How you may use Leads

Leads are licensed for your own real-estate business only. You may not resell, share, publish, licence or redistribute them, or load them into a database available to anybody outside your own business relationship, without our written permission.

9. How we contact you

By requesting the free trial, placing an order, or asking us to contact you, you agree that FlipItLeads and American Cloud, Inc. may reach you at the email address and telephone number you give us, including a mobile number, by email, telephone call (including calls placed with an automatic dialling system or a pre-recorded voice) and text message, about your order and about our products and services.

You agree to this even if the number is listed on a federal or state Do Not Call registry. Consent is not a condition of purchase — you may buy from us without agreeing to marketing contact, and you may withdraw at any time.

Message frequency varies. Message and data rates may apply. Reply STOP to any text message to stop texts, or HELP for help. Unsubscribe from marketing email using the link in any marketing email.

Messages about an order continue. Invoices, delivery of your Leads and refund correspondence are not marketing, and we send them for as long as we are performing your order.

10. Privacy

Our Privacy Policy explains what we collect and how we use it, and forms part of these terms.

11. Our liability

Leads are supplied "as is". To the fullest extent the law allows, we exclude implied warranties and we are not liable for lost profits or lost business. Our total liability for any claim is limited to what you paid us for the order concerned. Nothing here limits liability that cannot lawfully be limited.

12. Suspension

We may refuse or withdraw service and close an account where these terms are breached — in particular where Leads are resold or redistributed.

13. Changes

We may amend these terms. The version published here when you order governs that order.

14. Governing law

These terms are governed by the laws of the State of Nevada, and the courts of Clark County, Nevada have exclusive jurisdiction.
